Devant in AATT confusion

Devant's Missteps (http://www.guardian.co.tt/news/2011/11/13/devant-aatt-confusion)

Transport Minister Devant Maharaj has landed himself in a dilemma regarding the award of contracts at the Airports Authority of T&T (AATT).  The matter is now engaging the attention of Prime Minister Kamla Persad-Bissessar. Correspondence obtained by Sunday Guardian which was sent to the Prime Minister by the AATT chairman Vaman Bajnath details a list of ‘special requests’ Maharaj had instructed him to carry out. Maharaj, the line minister for the AATT, yesterday admitted in a telephone interview with the Sunday Guardian that he did in fact discuss some of the ‘special requests’ with Bajnath. At the centre of the exposé are the award of contracts and the short-listing of people to be hired for employment at the AATT.  The revelation comes on the heels of the minister’s move to have Bajnath’s appointment revoked following a vote of no-confidence against him on October 21. It was in a letter dated October 31 that Maharaj informed Bajnath a copy of the resolution was sent to Attorney General Anand Ramlogan for direction on the matter. But Bajnath, who has taken issue with the handling of the matter, and in attempt to clear his name, responded to the allegations in a tell-it-all style.

Bajnath chastised Maharaj for not affording him the opportunity to respond to the ‘baseless allegations’ before the matter engaged the attention of the Attorney General, claiming the rift between AATT board members was due to political interference and meddling. Bajnath stated: “The present wrangling and disruptive behaviour of members of the board is directly linked to the carrying out of the directions and desires of your office.”  Referring to Section: 12A (2) of the AATT Act which states: “In the performance of its functions and in the exercise of its powers, the Authority shall act in accordance with specific or general written directions given by the line minister,” Bajnath claimed that he facilitated the minister’s “expressed desires” since his appointment.

Chairman claimed he fulfilled minister’s ‘expressed desires’
Dismissing allegations that he failed to carry out instructions of the line minister in a timely manner, Bajnath listed several occasions to the Prime Minister where he allegedly fulfilled the minister’s ‘special requests’.

• Request: Favourable consideration for Bridgcom Ltd with respect to a three-year contract for grass cutting of the airfield, maintenance of the drains and fence line at the Piarco International Airport.
Action: At a July 2011 meeting, the board of the AATT awarded the contract to Bridgecom Ltd in the sum of $2,156,189 plus VAT per annum for three years for the grass cutting of the airfield, maintenance of the drains and fence line at the Piarco International Airport.

• Request: Favourable consideration for attorney Jagdeo Singh of Fortis Chambers to receive AATT Oropune legal portfolio.
Action: At the September 2011 board meeting, the appointment of Jagdeo Singh, Fortis Chambers to provide professional services in settling the legal issues associated with the relocation of the Oropune villagers.

• Request: Human Resources consultant to remain on a month-to-month contract.
Action: Members were advised at the August 2011 board meeting that the decision of the board taken to with respect to the renewal of a one-year contract for the human resource consultant will revert to a month-to-month contract on the basis that the potentially new appointee to the position of human resource manager possessed the capabilities and experience to address industrial relations issues.

• Request: Favourable consideration be given to three specific attorneys for the vacant positions within the AATT Legal Department. Action: The positions were publicly advertised, and the recommended people were shortlisted in preparation for the interview process.

• Request: Removal of board member Diane Hadad as chairman of the Business Development Committee (BDC) and or termination decision and instructing management to halt negotiations with various concessionaries in the absence of board approval. In addition, you advised that negotiations must continue with potential concessionaries.
Action: The BDC was immediately disbanded on the basis that the decisions taken with respect to the halting of negotiations with concessionaries were not in the interest of the authority nor was it approved by the board. Additionally, while the committee was established by the board, no terms of reference were documented and items discussed overlapped with the business of the operations committee. Furthermore, negotiations with the following concessionaries resumed without delay.

According to Bajnath, among the requests to be filled with the concessionaries are:
•T o issue a letter of commitment to open one food kiosk at the International Departure Lounge East and another in the International Departure Lounge West
• To lease 16 square meters of space at the south terminal for an Automated Teller Machine (ATM)
• To issue a licence to place an ATM at the north terminal
• To send a sample lease without rates
• To lease 172.69 square meters of office space at the south terminal
• To complete negotiations with the company when the review of rates and charges has been completed.
Bajnath also disregarded all grounds for moving the motion stating that the allegations were without fact and a breach of protocol.

Six against Bajnath on the board
The fall-out between Maharaj and Bajnath comes one month after chairman of the Port Authority of T&T Clive Spencer was fired. Spencer had claimed that he was given the boot because he refused to adhere to the minister’s directives. Sunday Guardian has been reliably informed that board members—Gary Kalliecharan, Suresh Ramdial, Emile Baptiste, Dyanand Maharaj, Ian Gomez and Diane Hadad voted in favour of the no-cofidence motion against Bajnath.

Citing grounds for the motion, the board members stated the following reasons for removing Bajnath:
• Has demonstrated total disregard for the AATT Act and procedures governing the authority, pertaining to his authority and decisions taken by the board.
• Failure to call a vote on motions which were proposed and seconded at the board meeting.
• Failure to carry out instructions of the line minister in a timely manner.
•  On several occasions displaying an inability to control and conduct board meetings in an orderly  manner
•Chairman has on occasions disregarded requests by members of the board to have employees of AATT leave the boardroom for private discussion.

Deputy chairman also under fire
The saga does not end there though, as Maharaj is also reportedly butting heads with the deputy chairman of AATT Felix Hernandez. This, after Maharaj claimed that a no-confidence motion was also moved against Hernandez on October 21. Maharaj also referred Hernandez’s matter to the Attorney General. As to which members moved the motion remains an issue of contention.

Six board members, Maharaj stated, gave the following reasons for their decision:
• Has demonstrated a failure to understand and comply with the AATT Act and procedures governing the AATT
• Unilaterally changing lawful decisions taken by the board
• Has on occasions displayed abusive behaviour towards members of the board and employees
• Allow misinformation to be presented to the board, despite objection from board members.
• On several occasions displaying inability to support chairman in conducting meetings in an orderly manner
• Displaying poor judgement with little regard for fair and natural justice.

Vehemently denying that the majority of members voted in favour of the motion, Hernandez responded to Maharaj stating: “I was present and attended the monthly statutory meeting of AATT on October 21. At that meeting no resolution was tabled or voted upon in terms of the enclosure in your under reference. One of the members of the board moved a motion of no confidence in me as deputy chairman. The motion was seconded. No notice was given of this resolution nor was any details supplied. Some discussion took place on the resolution but it was never put to vote and therefore not passed.” Hernandez who is weighing his legal options has deemed the allegations  as ‘vague’ and ‘malicious’, insisting that he acted in accordance with the provisions of the AATT Act.

Transport Minister responds to allegations

Contacted yesterday, Maharaj attempted to downplay the rift at the AATT insisting that the “board is very much in place” and Bajnath remains the chairman. Pressed further as to why he opted to refer the no-confidence motion against Bajnath and Hernandez to the Attorney General, Maharaj said: “No, no, it is not true I have not referred the matter to the Attorney General,” Maharaj said. However, when told that the Sunday Guardian was in possession of the correspondence dated October 31, that stated the matter was engaging the attention of the Attorney General, Maharaj then replied: “I have to see what you have before you.” On the issue of giving directives to Bajnath for the granting of ‘special requests’ in relation to the maintenance of the grass and fence line at the airport, Maharaj explained: “I have a letter from Bridgecom Ltd stating that they have some concerns with the tendering process. In terms of Mr Bajnath, I spoke to him identifying the concern of this person who tendered and that he should review the tender process if indeed the allegations made by Bridgcom is correct. “Subsequently, the board indicated that they did indeed find out that there were some problems with the evaluation criteria of that particular contract and they deliberated upon it and arised at the lowest bidder.”

Admitting that attorney Jagdeo Singh of Fortis Chambers has been retained to represent the interest of AATT regarding the relocation of farmers in Orpoune Maharaj said: “There was issue regarding the brief from the previous attorney amounting to $1.8 million or $2 million dollars. It was felt that that price was exceptionally high for the brief. I asked them to look around for other attorneys and my experience with Mr Singh is that he is reasonable; we are ensuring that we get value for money and not exorbitant legal fees.” The minister, however, was oblivious on the issue with the human resource consultant who has been hired on a month-to-month contract. As to whether he requested for three ‘specific’ attorneys to fill the vacancies in the legal department, Maharaj explained: “Since I came into office I have been getting request for jobs and so on. What I do is that I take the resumes and filter them out to the various departments and ask if they can consider them. As far as I know, the AATT has not met in a number of months to fill any positions.”   The minister, however, denied that he requested the removal of the BDC chairman. “Only recently, I was in Tobago with Ms Hadad; we have a good relationship. This issue with the BDC is one that troubled Mr Bajnath because he felt it was impeding some of the work he wanted to do in regard to the concessionaries. He identified that negotiations had halted because of the BDC.
“Those details with the concessionaries I would not know,” Maharaj stated. Attempts to contact managing director of Bridgcom Ltd Narindra Ramsubhag proved futile.

PS sends legal letter to minister

The permanent secretary (PS) in the Ministry of Tobago Development Hermia Tyson-Cuffie is demanding an apology from Transport Minister Devant Maharaj in relation to claims that she played a role in the alleged “slush fund” set up under the Community Development Scholarship Financial Assistance Programme. Through her attorneys Alexander, Jeremie and Company, Tyson-Cuffie, who was recently promoted to the rank of PS, has issued a pre-action protocol letter to Maharaj regarding statements he allegedly hurled at her outside the office of the Equal Opportunity Commission on October 25. Tyson-Cufffie, who has been employed in the public service for the last 36 years, is claiming that the statements identified her as a “player” in the alleged slush fund at the Ministry of Community Development, Culture and Gender Affairs.

In her claim for damages, the PS said the statements also imputed that during the period 2003 to 2007, when she held the position of deputy permanent secretary she acted in a racist manner, discriminated against people of East Indian descent, favoured and facilitated members of a political party and managed the Ministry’s funds in such a manner that they were dissipated and could not properly be accounted for. The statements, Tyson-Cuffie said, could be interpreted as she committed a criminal offence in public office under the relevant statutes of the Prevention of Corruption Act and the Integrity and Public Life Act. The permanent secretary further contented that the fund fell under the jurisdiction of the Minister of Community Development and Gender Affairs and was managed by a committee of which she was never a member of as deputy permanent secretary, since the inception of the programme in 2003. All recommendations, Tyson-Cuffie claimed, were approved by the relevant minister and payments were authorised by the then PS for the Ministry of Community Development, Culture and Gender Affairs.
Substantiating her claim, Tyson-Cuffie said no where in the alleged Equal Opportunity Commission report makes mention of her name or any responsibility attached to the office of the deputy permanent secretary that she formerly held.

April 30, 2012
Transport Minister Devant Maharaj is threatening Opposition Senator Fitzgerald Hinds with legal action.

Maharaj is alleging that Hinds made defamatory comments against him with respect to the award of contracts at the Airports Authority of Trinidad and Tobago (AATT) and the Public Transport Service Corporation (PTSC).

Attorney Joseph George, acting on behalf of Maharaj, has issued a pre-action protocol letter to Hinds dated April 27, 2012.

Hinds, at a press conference at the Opposition Leader's office, Port of Spain, on April 23, raised concern over the AATT award of a $2.1 million contract to Bridgecom to cut the grass at the Piarco International Airport as well as a $1.5 million contract to R2K Engineering Co Ltd for the repair and refurbishment of the San Juan Priority Mall.

With respect to the AATT contract, Hinds claimed that Bridgecom was not the lowest bidder as he quoted information from the AATT tender for the landscaping contract dated March 2011 which listed other companies which submitted bids for the project.

The pre-action protocol letter stated that Hinds's comments were defamatory and could be interpreted to mean that the Minister acted in an improper manner in the performance of his duties and obligations to country.

Hinds' charges, stated the letter, amount to "serious slander" and has caused the Minister considerable distress and embarrassment as the allegations were false and unjustified.

Maharaj's attorney has demanded a full and unequivocal retraction and apology—on terms approved by counsel and published in all daily newspaper and Internet websites—at Hinds's expense.

Hinds was asked to submit a proposal for a "substantial compensation" for the injury caused to Maharaj's reputation—including an award for aggravated and exemplary damages.

He was given 21 days to respond to the pre-action protocol letter failing which legal proceedings will be initiated.

Dayanand Birju

Former acting general manager of Airports Operations at the Airports Authority of Trinidad and Tobago (AATT) Dayanand Birju’s certificate from the University of Massachusetts, Boston, in the United States is a fake, the university confirmed yesterday.

The certificate, which stated he was awarded a Bachelor’s degree in computer science in 1988, was part of his curriculum vitae which led to him obtaining a managerial position at the AATT.

The position saw Birju receiving $40,000-plus a month in salary and perks.

Speaking with the Express yesterday morning, David Cesario, registrar of the University of Massachusetts, Boston, said after inspecting the certificate, “I have reviewed it and it is not authentic.”

Cesario said, four days ago, a request was made by the AATT as to whether the “certificate” was authentic. A reply has since been sent to the AATT.

Birju had said he had a BSc in computer science which was awarded on May 28, 1988 from the university.

Cesario confirmed that Birju did attend the university “from fall 1983 through fall 1987”, but did not graduate.

Cesario, when asked what action, if any, the university could take with regard to the certificate, said: “At minimum, if it is from a student, we would turn the case over to Student Affairs as a violation of the Student Code of Conduct.”

The document tendered by Birju has discrepancies.

For instance, it lists “Peter McFarlene” as the university president.

But Registry officials at the university told the Express yesterday they knew no one by that name who served as president of the university.

“Ma’am, if you go to our website, you will see all our past presidents.

From 1978 to 1990, I can tell you that Mr David C Knapp was the president of the University of Massachusetts,” the official said.

Did Peter McFarlene at any time serve as the president?

“Ma’am, the information recorded shows that no Mr McFarlene served as president at any time at this university,” the official said.

The official was further asked if “Thomas Alan Caretherson” and “Veronica Miles” had served at the institution in the capacity of chancellor, Boston Campus, and chief, board of trustees, respectively, at any time, as stated on the certificate.

The official said no.

Birju tendered his resignation to chairman of the AATT Trevor Benjamin last Tuesday.

Sources say the resignation was with immediate effect.

Shortly after assuming the chairmanship of the AATT in September, Benjamin requested Birju’s CV, sources said.

Birju said that his CV would be made available last week to Benjamin, but this did not happen and the Express was informed by sources that Birju did not produce the university transcript from the institution.

Efforts to contact Birju again yesterday were unsuccessful as calls to his cellphone and home phone went unanswered. Messages left were not returned.

When he was offered the position of deputy general manager, Airports Operations on August 10, 2010, Birju’s basic monthly salary was $24,000.

This figure did not include allowances.

A copy of his contract obtained by the Express showed perks such as travelling, entertainment, telephone and housing allowances. The allowances were $3,000, $500, $350 and $1,500, respectively, per month.

Birju also qualified for a motor vehicle loan up to $140,000 to be repaid within three years.

The offer contract was signed by then AATT general manager (ag) Louis Frederick.

Contacted on Monday, Frederick said he was presented with an “original” certificate. He said the certificate highlighted in the Express was the same one that was presented.

Asked if checks were made to determine the authenticity of the document, Frederick said: “No, because the original was submitted and we made a copy.”

Did you or the AATT check the copy with the university? the Express asked.

“No, what I remember, the AATT never did any checks like that. If you bring in the original certificates, they are copied and given back to you.

“Looking back at it, I have never had cause to do that (call a university) and I don’t think the (AATT) did that with anybody,” Frederick said.

Sources say the document was also submitted to Caribbean Airlines Ltd.

Efforts to contact Transport Minister Stephen Cadiz, as well as AATT chairman Benjamin, have been unsuccessful.

The Express learnt that, following his resignation, Birju informed the AATT that he had 45 days’ vacation leave and requested that he be paid for them.

Management at the AATT gave the undertaking that his claim will be looked at.

On January 16, 2012, the AATT board appointed Birju to act as general manager for six months.

His compensation package included a monthly salary of $32,000, transport facilities — $3,000, entertainment allowance — $1,500 and housing allowance — $3,000.

BIRJU CHARGED
Former Airports Authority GM in custody over ‘false degree’

By By Denyse Renne denyse.renne@trinidadexpress.com

Former acting general manager at the Airports Authority of Trinidad and Tobago (AATT) Dayanand Birju has been charged with two counts of fraud.
This was confirmed yesterday by Deputy Commissioner of Police Glenn Hackett who said Birju was in police custody.
Birju, sources say, was held at his San Fernando home on Friday at around 9.15 p.m. and taken to Fraud Squad headquarters at Richmond Street, Port of Spain.

He is expected to appear before a Port of Spain magistrate tomorrow charged with obtaining money by false pretences and uttering a false document.
Last September, the Sunday Express through a series of exclusive stories claimed that Birju had submitted a bogus degree certificate which stated he had a BSc in computer science from the University of Massachusetts, Boston, in the United States.
The certificate stated he was awarded the degree in computer science on May 28, 1988.
This formed part of his curriculum vitae submitted to the AATT to obtain the managerial position he held.
Sources said the former AATT board led by Trevor Benjamin and line minister Stephen Cadiz did not lodge an official police report.

Several letters were written to the board by its legal department last September alleging offences had been committed and the police ought to be contacted, sources said.
Sources told the Sunday Express that Hackett initiated an investigation and mandated detectives attached to the Fraud Squad to probe the matter.
Hackett supervised the investigation which was led by Snr Supt Edwards.

The detectives throughout their investigation visited AATT senior personnel and requested certain documentation.
However, on Friday afternoon, the detectives received written correspondence from the university in the United States.

During its investigation, the Sunday Express on September 24 last year contacted David Cesario, registrar of the University of Massachusetts, Boston, asking him a series of questions.
He was also e-mailed a copy of the certificate tendered to the AATT.
Cesario claimed after inspecting the certificate, “I have reviewed it and it is not authentic.”
Cesario said prior to the Sunday Express request the AATT also requested information as to whether the “certificate” was authentic.
A reply has since been sent to the AATT.
Cesario had confirmed that Birju attended the university “from fall 1983 through fall 1987”, but did not graduate.
Sunday Express investigations also claimed the document tendered by Birju contained discrepancies.
For instance, it listed “Peter McFarlene” as the university president.
But Registry officials at the university told the Sunday Express they knew no one by that name who served as president of the university.
“From 1978 to 1990, the university listed Mr David C Knapp as president of the University of Massachusetts.”
The names “Thomas Alan Caretherson” and “Veronica Miles” also appeared on the document. They were listed as serving at the institution in the capacity of chancellor, Boston Campus, and chief, board of trustees, respectively. This was also alleged to be inaccurate.
Birju’s basic monthly salary at the AATT in the post of acting general manager was $41,500.
He received an acting allowance of $16,000, entertainment allowance of $2,000 and housing allowance of $4,000.
Collectively, he received $63,500 per month.

Background

Birju tendered his resignation to then chairman of the AATT Trevor Benjamin on September 19 last year.
He cited personal reasons.
When he was offered the position of deputy general manager, Airports Operations on August 10, 2010, Birju’s basic monthly salary was $24,000.
This figure did not include allowances.
A copy of his contract obtained by the Sunday Express showed perks such as travelling, entertainment, telephone and housing allowances. The allowances were $3,000, $500, $350 and $1,500, respectively, per month.
Birju also qualified for a motor vehicle loan up to $140,000 to be repaid within three years.
On January 16, 2012, the AATT board appointed Birju to act as general manager for six months.
His compensation package included a monthly salary of $32,000, transport facilities $3,000, entertainment allowance of $1,500 and housing allowance $3,000.
Shortly after all managers at AATT received a pay increase. This increase showed Birju’s compensation package as follows. Basic monthly salary $41,500; acting allowance $16,000; entertainment allowance $2,000; housing allowance $4,000.
Transport Minister Stephen Cadiz had stated in previous interviews that Birju and his relatives were embarrassed enough by the stories.
“I am not sure what we will do, whether we will report and let the police deal with it or consider that Mr Birju has sent a message, that if found out, (the public) will be very embarrassed,” Cadiz had told the Express on September 27 last year.
When the issue was raised publicly, officials at the AATT contacted the university querying the certificate and were told by university personnel that any information pertaining to Birju would need his permission.
The AATT never made any attempt to contact Birju, since according to AATT sources, Birju had resigned from the post. The directive to seal all information came from Birju to the university, sources had said.

Entire AATT board replaced
By Joel Julien (T&T Guardian).

The entire board of the Airports Authority of Trinidad and Tobago (AATT) has been replaced one year before their appointments were officially expected to have ended.

On January 15, all six members of the Keith Thomas-chaired AATT tendered their resignations.

The other members were Colonel Lyle Alexander, Joseph Granville, Earl Wilson, Dawn Callender and Reshma Maharaj.

These six members were re-appointed to the AATT board for a period of two years effective February 7, last year.

It was their second two-year appointment to the board after first being appointed on January 23, 2018.

Works and Transport Minister Rohan Sinanan said there was nothing untoward with resignations and that it was simply a replacement of the AATT board.

The AATT’s Corporate Communications Manager Zola Joseph yesterday said Vishnu Dhanpaul has been named the AATT chairman.

Dhanpaul and five others were appointed to the AATT board for a period of two years, with effect from January 20

The other members of the board are James Philbert as Deputy Chairman, and Adana Bain, Savitree Seepersad, Mark Romany, Dhanmattee Ramdath, Christopher Alcazar and Jamil Sulaimani as members.

The AATT is a statutory body established by the Airports Authority Act, No 49 of 1979.

It falls under the portfolio of the Ministry of Works and Transport.

The mandate of the AATT is to develop and manage its airport estates, including the development, maintenance and improvement of its facilities, so as to ensure the availability of efficient, secure and safe aviation services and commercial viability.

Both international airports, the Piarco International Airport and the ANR Robinson International Airport are managed and operated by the AATT.

Airlines return to Trinidad and Tobago airports
PAULA LINDO (T&T NEWSDAY).

The Airports Authority of Trinidad and Tobago (AATT) says all airlines which operated out of the Piarco and ANR Robinson airports before the closure of TT’s borders in March 2020 have returned.

AATT’s corporate communication manager Zola Joseph told Newsday most airlines have provided winter schedules and should resume operations between September and November.

The authority, on its website, said the airlines operating out of Piarco include American Airlines, Air Canada Rouge, Venezolana, JetBlue, British Airways, Copa Airlines, Liat, Suriname Airways, Turpial Airlines, Caribbean Airlines, United Airlines, WestJet, Rutaca, and Trans Guyana Airways.

The airlines operating out of Tobago’s ANR Robinson airport include British Airways, Caribbean Airlines, Condor and Virgin Atlantic.

In response to e-mails, Joseph said KLM Royal Dutch Airline is expected to start the route Amsterdam – Barbados – Trinidad – Amsterdam (AMS- BGI-POS-AMS) in November.

“The authority has continued to work in close collaboration with the Ministry of Tourism, Culture and the Arts and the ministry’s implementation agency, Tourism Trinidad Ltd (TTL), as well as the THA’s Tobago Tourism Agency, to increase airlift into destination TT.

KLM is a Skytrax four-star rated airline and has an extensive network which includes services within Europe and to Asia, Africa, North America, Central and South America, and the Middle East.

“This route will allow us to build a market in Europe and undoubtedly assist with ongoing tourism efforts.”

She said the authority had been able to continue operations at TT’s airports via a suite of robust covid19-mitigating measures in collaboration with the Health Ministry.

“Our covid19 response systems have helped us to achieve accreditation through the Airports Council International (ACI) Airport Health Accreditation (AHA) programme.

“The programme provides airports with an official assessment of how aligned their health and safety protocols and procedures, introduced because of the covid19 pandemic, are in accordance with International Civil Aviation Organization’s (ICAO) Council Aviation Restart Task Force (CART) recommendations. We continue to assess and evaluate our protocols.”

Joseph said the covid19 safety protocols at both airports include: face masks being required for entry into terminals and to be worn at all times in terminal buildings; temperature screening at entrances, international arrival points, and before security checkpoints; installing distanced seating, signage and floor markers to guide physical distancing of airport users; increased hand sanitisation stations throughout the terminal buildings; and physical distancing at all times.

Measures have also been put in place to protect all frontline staff.

These include the mandatory use of face shields in addition to face masks, both of which have been provided to all workers; the restriction of occupancy for all AATT vehicles to 25 per cent; the installation of sanitiser stations at all entrances to buildings and at strategic locations; the provision of personal sanitisers; increased cleaning, disinfecting and sanitising of work stations and all touch points; and, airport frontline workers have been given opportunities for vaccination.

Joseph said the authority is making every effort to ensure the safety of its workers, travellers, stakeholders and all airport users.
