Of pyrrhic victories and the rule of law

I have noted the response of the Honourable Prime Minister to Monday’s ruling of the High Court in the TTFA v FIFA matter in which the PM said, among other things: “So now United TTFA has ‘won’ and FIFA has lost. The matter is settled in local court. We are now free of the ‘colonial’ FIFA. We, boys and girls, men and women, are free to play by ourselves and against ourselves because nobody will be allowed to play with or against us. Oh. That’s it! I finally understand it. That means we can never lose and will always win because we will only be playing by ourselves.”

I, however, find it difficult to share in the enthusiasm of others who gleefully welcome the obvious sarcasm of the PM’s comments.

Let me state two points before I am accused of bias or worse.

Firstly, I would have thought the FIFA appeal against the jurisdictional ruling of the court, which is imminent, would have been sufficient for this ruling to be postponed pending the Appeal Court’s ruling.

Secondly, I hold no brief for William Wallace or the TTFA executive, and my criticism of their handling of this issue (as others have said) is that they failed, as leaders, to fully involve their members in what is the most significant action they were embarking on.

However, I think it is important to note the TTFA (unlike many other football associations elsewhere) is a statutory organisation created by our Parliament by an act.

In Monday’s judgment, the court noted: “FIFA has now taken to making repeated demands accompanied by threats to TTFA, most recently through its Normalisation Committee to amend its rules to ‘bring them in line with FIFA Statutes’.

“There is no lacuna. The futility of these threats and demands should by now have become obvious. TTFA simply cannot deliver. The only amendment that can produce the result that FIFA commands is an amendment to the TTFA Act, and if it insists on blocking access to our courts in favour of the CAS (Court of Arbitration for Sport), then it should be put on notice there might be constitutional hurdles.”

This aspect of the ruling should be of concern to any lawmaker in our nation’s Parliament. What it points to is that FIFA is, in effect, seeking to direct our nation’s Parliament on what to do with an act of Parliament which it passed to give life to the TTFA.

I am sure that the Honourable PM must be concerned about this.

A statutory body as the TTFA decided, when its approach to CAS was treated by that court with bias toward FIFA, allowing FIFA to refuse to pay its share of the cost of arbitration, for example, to approach the court of the land.

That is its right, like that of any citizen, to seek redress in the courts of this country.

The judgment points out: “The wisdom of the challenge by the (TTFA officials) of the actions of FIFA is not for the court (to decide)... But it has to be said that the law expects the TTFA to do what its statutory duty requires even in the face of unlawful pressure.

“(...) In the circumstances, the TTFA’s actions of seeking redress before the court was perhaps the only appropriate response which avoided capitulating to the demands of FIFA; and thereby elevating the status of FIFA Statutes above the laws passed by our Parliament.”

Again, any lawmaker who has sworn to uphold the Constitution and the law, and who holds the rule of law as a pivotal constitutional principle of our governance, must be concerned that any person (citizen or corporate) should be facing pressure from anyone, worse the defendant in a claim before our courts to abandon their claim, including threats as FIFA has not only made, but, put into action.

The judgment quotes the following from an English case (R v Coventry City Council) on the issue of public authorities and responding to unlawful threats: “Tempting though it may sometimes be for public authorities to yield too readily to threats of disruption, they must expect the courts to review any such decision with particular rigour—this is not an area where they can be permitted a wide measure of discretion.”

The fact that our Parliament, at the instance of the Government, may eventually have to decide what to do with the TTFA Act should impress the seriousness of this situation as a matter of the rule of law.

This is not merely a matter of whether “we will only be playing by ourselves”, as the Honourable PM ended his comment on the judgment. This is a matter of whether the rule of law in our country will be respected by an international sporting body.

I am not aware of any other international sporting body attempts to deny citizens their right to approach the courts of our land (or any other), or even to tell any country what to do with its laws.

This is a profoundly serious matter for the principles of our nation’s governance, its sovereignty and whether a non-governmental body’s rules can be regarded as superior to the law of our land. It is that serious.

To successfully defend our governance against external pressure, as our country has done on several occasions in the past and recently, can never be a pyrrhic victory.

my goodness this emile crown guy is such a prick. it's unbelievable how easily he became unravelled like a spoiled child who hates being challenged. how fragile an ego he has. as a trini i'm extremely appalled  by his conduct.

I am usually a firm believer in Dr. Rowley...but this is now the 2nd time that i have to question his judgement. What is more important....bending over and letting FIFA 'give it to you'.... for the sake of a few dollars ??? Or standing up to the oppression of your people  ???
At this point I really don't care to be a member of FIFA if this is how they treat its members.

Ok so FIFA are the owners of football...as some would  have us believe..... but didn't the Government of TnT give the TTFA a job to do ???? To administrate football in TnT ??? Even before it became a member of FIFA ???
Who was paying the coaches then ???
Why is it ULTIMATELY FIFA's responsibility to fund the TTFA ???
If the debt was created while using FIFA funding then who's responsibility does that fall under ???
If you are unhappy with the performance of one of your members...the same way you worked hand in hand with them to incur the debt.....why not work hand in hand to clear that debt ???

No....you  crack your wipp and get rid of the people in charge....and replace them with people who have no affiliation or previous desire to serve our people.
If FIFA really cared about football...or even their money....they would have acted in a better manner.
I am sure that if the money was owed to FIFA the approach would have been different. Their pumping of money into Trinidad and Tobago football was a calculated ploy not to the development of the game here.....but to control the "Big Fish"(one of) in CFU to control votes....

If Watson Duke the, ultimate bully, had any 'testicular fortitude' he would have been all over this. Not even Kamala you hearing.


Please be respectful if you disagree with me because I have become very emotional about football in the years since I have started coaching youths. One of the reasons that I don't post as much.

Norway clobbered Honduras 12-0 in U20 World Cup. It appears that with the exception of the US, the rest of Concacaf did not make the 2nd rounds or are unlikely to make the 2nd rounds. But Panama still has a chance today against Saudi. Honduras had two players sent off.

Norway forward Erling Braut Haland set an Under-20 World Cup record with nine goals in the country’s 12-0 win over Honduras on Thursday in Poland.

Haland, who plays club soccer for RB Salzburg, scored four times before halftime and five times in the second half as the Norwegians didn’t stop attacking against Honduras. Haland’s effort broke the previous record for goals in a game by a single player by three.

You’re probably thinking Norway showed poor sportsmanship in running up the score against a clearly overmatched opponent. But they had to do so to move on.

Norway needed to worry about goal difference
The U20 World Cup consists of 24 teams divided among six groups and 16 of them make the knockout stages. With the top two countries from each group moving on, that leaves four third-place teams to make it through to the final rounds.

Norway, in Group C, lost its first game 3-1 to Uruguay on May 24 and lost its second game to New Zealand 2-0 on May 27. Honduras, meanwhile, lost to New Zealand 5-0 and 2-0 to Uruguay. The winner of their game Thursday, at best, would advance as the last third-place team.

Hence why Norway kept scoring. Before the game kicked off, three teams were already in third place with four points. Norway not only needed to get three points, but it needed to flip its goal difference — the first tiebreaker — to a lopsided number that no one could match and hope for the best from games on Friday.

Norway still not in the knockout round
After the win, Norway’s goal difference sits at a mighty +8 and its 13 goals over three games are the most of any third-place team. But there’s no guarantee the Norwegians will advance as the last team in the knockout round.

Argentina leads Group F with six points while Group F teams Portugal and South Korea currently sit tied with the Norwegians at 3 points. Meanwhile, Group E member Panama has one point. All of those teams play tomorrow. And a lot has to go right for Norway.

Norway only advances if Portugal and South Korea both lose and Panama loses or ties. A win for Panama vaults the Panamanians over Norway while any combination of wins or ties for Portugal and South Korea also eliminates the Norwegians. The running up of the score could very well end up for naught.

Even 17 is pushing it. Only a couple great ones made it past that age and phase. Ridiculous idea. The history, science and sense says No. Just the social aspect causes issues in all manners of life. This is well documented as a detriment to growth.
So what about the 17 and 18 year olds playing across Europe. Didn't a 17 year old score 2 for Barcelona this weekend. Or even closer to home.....does anyone remember a certain Dwight Yorke.
All those Signal Hill Championship teams....who you think they used to play against before they came to Trinidad ??
Do you know how old DY was when he was introduced to football?
Not sure of the exact age but it was primary school. And he was on the national U14 by the time he was 11 of 12 i think....Bertille does always talk about that.

As a coach I was part of a program that took 2nd and 3rd formers that were part of a club program and played then in an adult 'village league'. the results over the 2 years that they participated were exceptional. The first year they lost heavily and the learning curve was steep. At the end of the first year they were miles ahead of their peers. By the end of the 2nd year one boy was training with the National U17 with the likes of Shanon Gomez and levi Garcia. Another eventually left on football scholarship.

You do the math.

The math is irrelevant. Were they the biggest kids by chance? It's hard to tell who succeeded and who failed because of that decision. We tend to have confirmation bias when considering these things.

Former National Youth player(and Captain) Roderick Anthony died last night in a vehicular accident. I dont have all the details but he was returning from the wake of the young man we was the 1st road fatality of the year in Tobago on new years day. The accident occurred in the vicinity of the Buccoo traffic lights.

I ent see no apologies on the selection speculation comments that was going on before. People did stop qualifying their statements as if they was in the know that people were purposefully not getting called.  :( Blame as well as credit whenever rightfully due.

In life there are consequences for bad actions and results. Go choose the wrong mechanic or the wrong dentist and then your wife or friend blame you after bad results, then later you choose the right mechanic or dentist then what you expect? you expect your wife to apologise?

It seems to suggest that the coach did not utilize the most effective combination of players or does not know the best combination or even with the best combination the desired results will not be achieved. What was the outcome of your maths?
Against Costa Rica
we collect 3 busy busy in the first half....changes made and no more goals conceded.

Against Barbados
we scored one and conceded one....even though the quality of the opposition was lower

Against Portugal
we held them first half...but we conceded 2 goals in the last 5 minutes. Personally i cannot be too upset with that as they were the eventual winners of the competition. And i dare say that we could have been in front in this game but for great goalkeeping.

Against Guatemala
We leading 2-0.....then we make changes and concede 4 goals.......WTF

We conceded goals in bunches in the first and last games......Check and see who was on the field and who was on the bench when all the goals were being conceded.

So people.... we played against a team ranked about 70 places above us and held them to  draw and we can find nothing positive to say about our game. What did you all really expect ?????????
How many players were missing....both defensive and offensive....

No Sheldon Bateau or Aubrey David and we still held out
No Kevin Molino, Jovin Jones, Willis Plaza, Athulla Guerra.....not even Rundel Winchester and you expect to see an offense that would trouble a team ranked 26th in the world.

Marvin Phillip in goal...… Clean sheet......magnificent performance and what ??? Not a word about his performance..... Let him miss one against Canada and nobody even wants him on the squad.
