I'm not suggesting this may be linked to the Minister of National Security, but these continuing financial suspicions allegedly involving cabinet ministers must be of concern to the P.M.?

Bank raises red flag with FIU

Republic Bank has alerted the Financial Intelligence Unit (FIU) to the suspicious transactions of a senior government official. The bank, sources say, raised a “red flag” after the official paid off two million-dollar mortgages within a six-month time frame. One of the mortgages was for a property purchased through the official’s private company in 2010 valued at $1.75 million, while the other was for a property purchased in September 2011 at a cost of $3.3 million.

 The bank initially started its own investigation late last year after discovering the mortgages were fully paid off. Bank officials noticed that apart from the monthly payments, the government official was also making payments on a daily basis towards the mortgages. The daily payments, sources say, were close to $42,000 and were paid at different banks throughout the country. Banking officials, however, say there is a $60,000 per day limit on the amount of money which can be deposited in personal accounts.

“Anything higher than this, individuals will have to declare a source of funds,” the banking official, who did not want to be named, told the Sunday Guardian.

According to banking regulations issued by the Central Bank, and under the heading large/suspicious transaction records, “financial institutions should review and properly document the background and purpose of all complex, unusual, or large transactions…every financial institution which receives cash, bank cheques, drafts, money orders or traveller’s cheques in an amount in excess of the threshold shall keep and retain a large transaction record...”

Following investigations by Republic Bank, it was discovered that the government official also has accounts with other banking institutions. However, no money was withdrawn during the said period in which the daily deposits to Republic were made on the mortgage accounts. It was after this internal probe was completed that Republic Bank alerted the FIU of the transactions.

In response to questions from the Sunday Guardian on the matter, Republic Bank, through its Corporate Communications and Marketing Department, said in a statement, "We are unable to reveal actual bank procedures. However, and as you would imagine, we cannot comment on any transactions which might or might not have occurred.

“The bank is guided by the Proceeds of Crime Act 2009 in identifying and reporting transactions which might be considered suspicious based on descriptions provided by Section 55 of the act.” The FIU, in a release in response to questions as to whether a report was made to them by Republic Bank, said such disclosures are confidential, adding should they be made public it would breach sections 21 and 24 of the FIU Act.

The intelligence unit is headed by Susan Francois, while Nigel Stoddard is its deputy director. Asked specifically whether the government official is currently being probed, the FIU said: "The subject of a suspicious transaction activity/reports (STR/SAR) is confidential information. The FIU cannot disclose the person who is the subject of a STR/SAR.

“The FIU cannot disclose whether it has sent an intelligence report to law enforcement agencies (LEA) for their investigation, or whether an investigation has commenced on an individual or legal entity.” The release further said should such confidences be breached, an FIU officer would face the penalty of a fine of $250,000 and three years' imprisonment.

Last August, Attorney General Anand Ramlogan said some 300 reports involving suspicious-activity transactions were made to the FIU. He was speaking in the Senate on the Miscellaneous Provisions (Financial Intelligence Unit of Trinidad and Tobago and Anti-Terrorism) Bill 2012.

Warner sued for $1.2m
Company claims non-payment for printing, signage

National Security Minister Jack Warner has found himself entangled in another legal battle relating to his former tenure with Federation Internationale de Football Associations (FIFA). This time Warner is being sued for more than $1.2 million by a local company, Graphix Advantage Ltd, for alleged non-payment for printing and installing of signage for the FIFA Women’s World Cup Under 17 in T&T in 2010.

Yesterday Justice Frank Seepersad described as unacceptable Warner’s non-attendance in the matter, saying at the last hearing in January he specifically requested Warner to be present. Citing Standing Order 27 5(2) of the Civil Proceedings Rules, the judge said Warner has a responsibility to appear in the matter. He said court attendance must take primary precedence over any other activity. Attorney Dereck Balliram, who with attorney Om Lalla appeared for Warner, apologised but gave no reason for the minister’s absence.

The judge ordered that Warner be present at the next hearing on September 25. Warner is named as the second defendant while T&T Football Federation (TTFF) is named as the first defendant in the matter in the San Fernando Civil Court. The company, through its managing director Imamuddin Baksh, is being represented by Hendrickson Suenath SC. Attorney Derick Ali, who is representing TTFF, was also absent yesterday. Parties were ordered to file witness statements by July 19.

The claim
 
In the statement of claim, Baksh said at the time of the business transaction he was the personal assistant to Warner, then works and transport minister. Baksh is claiming Warner was then the special adviser of TTFF and chairman of the de facto Local Organising Committee (LOC) of the FIFA Women’s World Cup Under 17, 2010 competition.

Baksh is also claiming Warner “requested and instructed” him to print and install signage at all the stadia where the competition was to be held. Warner, according to Baksh, assured him “that payment for said work would have been paid by him on behalf of LOC.” Baksh said invoices for the total sum of $1,360,968 for the printing and installing of large posters/banners were duly delivered to TTFF.

He said in November 2010 he was paid $98,555 by a cheque drawn on an account in the name of LOC South Africa 2010 Ltd. Baksh claimed he made numerous requests for the balance $1,262,413.19 but to no avail. He said he was subsequently fired in 2011.

Warner’s defence

In documents filed by Warner and TTFF, both defendants are denying allegations made by Baksh. Warner’s defence, according to court documents, is that all transactions and agreements were made with the LOC of FIFA’s Women’s World Cup Under 17, 2010 and not him in a personal capacity and all goods and services were received by the LOC.

Warner denied he was the de facto chairman of the LOC because at all material times management of competition were under control of the LOC and its chief executive officer, Nataki Kerr. TTFF’s also claimed all business transactions were done with LOC and not TTFF.

How Warner duped FIFA, Concacaf into believing they owned the $144m Centre of Excellence.
Part III of a Special Investigation Camini Marajh Head Investigative Desk (T&T Express).


THE GREAT DECEPTION

For over a decade, football power broker Jack Austin Warner hid a US$22.5 million asset in plain sight on the balance sheet of football’s ruling body for North and Central America and the Caribbean (Concacaf) of which he was president.

And for just as long, Warner was collecting hundreds of thousands of US dollars in member services and building maintenance fees from Concacaf for an asset—the Dr Joao Havelange Centre of Excellence—that many in FIFA, football’s world governing body, and Concacaf considered to be the crown jewel of the regional football federation.

The only wrinkle in this long standing arrangement between the football confederation and its ex-president of two decades is ownership of the asset.

Persons familiar with the situation told the Express that FIFA and Concacaf were duped by its ex-top official Warner into thinking that the regional football body owned the sprawling 16.9 acre sporting complex complete with artificial turf ground and 33-room hotel.

The land on which the US$22.5 million FIFA-Concacaf built and paid-for facility sits on, is owned by Jack Warner and two of his private corporations, CCAM and Co Ltd and Renraw Investments Ltd.

The Warner deception was discovered last June by Cayman banker and new Concacaf president Jeffrey Webb who retained the global law firm of Sidley Austin LLP and audit and consulting firm BDO to conduct a forensic audit into Concacaf’s finances.

At a news conference in New York last September, Webb said the Confederation’s executive committee had agreed to give investigators more time. "This audit is a massive undertaking that will set our financial house straight and ensure that Concacaf’s operations are executed in a responsible and ethical manner," he said.

Chairman of Concacaf’s Integrity Committee, Sir David Simmons, a former chief justice of Barbados, will reveal the findings of the forensic audit first to delegates of the Confederation’s annual congress in Panama City tomorrow and then to the international media on Friday.

The question of whether the Confederation should go after its former boss in relation to the loss of a valuable asset—the Centre of Excellence —will be put to the floor for a vote tomorrow, according to Concacaf insiders. Also headed for discussion is whether the Confederation should extend its forensic investigation to Port of Spain, specifically, the Trinidad and Tobago Football Federation (TTFF) of which Warner was special adviser up until 2011, said one source.

The annual congress will also deliberate on whether the Caribbean Football Union (CFU) of which Warner was also president should be added to the laundry list of Warner-associated football bodies to be investigated. Reuters had reported that the Federal Bureau of Investigations (FBI) and US tax authorities are already on the CFU case.

How was Warner able to dupe FIFA and the Confederation on the ownership of a US$22.5 million asset for so long? Insiders say the answer lies with the lack of a proper governance structure inside the Warner-controlled Concacaf and the symbiotic relationship between Warner and former close pal turned whistle blower and general secretary of the Confederation, Chuck Blazer.

Financial records and other Concacaf documents obtained by this newspaper show that the Centre of Excellence was listed as an asset on Concacaf’s books by the Warner-hired auditor, Kenny Rampersad of 3A Queen’s Park West, Port of Spain.

In the audited financial statements for 2010, presented at the May 2011 congress in Miami Beach, Rampersad lists the Centre of Excellence as a fixed asset on the Confederation’s balance sheet. His note to the account, however, Note 5 describes the asset as "freehold property," which implies ownership of both land and building. Property record searches show that Warner has legal title to the three parcels of land on which the buildings known as the Centre of Excellence sits.

Further in his audit report, in the Notes to Financial Statements, the Warner-hired accountant says this is in relation to freehold property: "Amortisation of freehold property refers to the freehold property that houses the Dr Joao Havelange Centre of Excellence. It has been computed at two per cent of historical cost."

A financial expert told the Express that amortisation is more appropriately used to describe leasehold property. Concacaf insiders say that all of the Rampersad audited statements have the Centre of Excellence listed as a fixed asset on the accounts.

The audited statements also show steady US dollar cash flows going into the Warner-run Centre of Excellence. In Note 9 of the 2010 accounts, under the heading "Member Services", Concacaf paid out US$578,608 to the Centre of Excellence for what is described as "courses". The previous year, Concacaf paid out US$650,738.

In 1999, the Centre of Excellence raked in US$1,415,388 from Concacaf for courses run at the Centre of Excellence. In 2001, the figure was US$2,291,762. And while Concacaf’s books reflect ownership of the Trinidad asset, there was no income stream from the sporting facility managed by its former president and landowner of the Macoya sporting facility.

Revenues for trade shows, concerts, weddings and other events held at the Centre of Excellence stayed with the Centre of Excellence, according to Concacaf’s records. When BDO started its investigation into Concacaf’s muddled finances last June, it discovered that the Confederation’s former president had taken an unauthorised mortgage on the Trinidad property in June 2007. The First Citizens bank charge is secured by the property—i.e. land and building.

Jack Austin Warner signed the bank charge as a director of both CCAM and Renraw Investments. His secretary of long standing, Patricia Modeste, signed as secretary to the two Warner companies. In making the Confederation a party to what BDO say is an unauthorised mortgage, Warner used his authority as president of the football body to sign an $11 million bank charge.

He had Lisle Austin, the vice president Caribbean Concacaf, co-sign the mortgage agreement but Austin, in an interview with the Express, said he did not see the preceding pages of the document he signed and did not understand what he signed in Warner’s Concacaf office at 113 Edward Street in Port of Spain to be a mortgage document. He said he was duped by Warner.

The mortgage also speaks to a Concacaf board resolution but persons familiar with the situation say the board had no knowledge of the $11 million mortgage charge created by its former president who has refused to answer questions about anything.

Rampersad, Jack’s main accountant of choice, also played a key role in another Concacaf mortgage charge drawn up in 1998 in favour of First Citizens. And while this one had the approval of Concacaf’s board, Rampersad signed as company secretary to two Warner companies—CCAM and Renraw—which hold beneficial interests in the land on which the Centre of Excellence sits.

At the time of signing, however, Warner's son Daryan was the secretary of the two private corporations, according to records at the Registrar of Companies. Rampersad was never company secretary of either of the two companies.

In a brief phone conversation with the Express, Rampersad said if his signature is there, "then it means I signed in some capacity or the other". Told that he was not the company secretary on record at the time, he said:"I really can’t remember. I stopped doing work for Centre of Excellence." He declined further comment.

Warner also received monthly US$25,000 cheque payments from Concacaf for rent of the Confederation’s Trinidad office which was situated in his building at 113 Edward Street.

He acquired the property in 1997 for $875,000. The national football federation was also paying rent for the other side of the same building which stretched across to Dundonald Street. TTFF was said to be paying about $40,000 a month.

As I mentioned before, mainly Carmini has brought together the information thats been out there for years and put it into one story. Remember much of this was uncovered by Lasana. The CoE ownership revelations were his, for instance. So Lasana can't print most of this as its old news (in fact, I believe he's still being sued by Warner for some of this stuff!)

The great value in Carmini's work is that once you put it all together in one place, you realise just how much Jack is involved with. I mean, has anyone been keeping count? US$30k per month here, $100 million there, US$40,000 here, pretty soon you're talking about serious money.

It will be interesting to see her story on Sunday, but by then she may be scooped by events in Panama. If Webb went through the CONCACAF accounts the way Townley and them went through the TTFF accounts, Fridays media brief on the forensic audit should be very interesting.

Cash probe details to be revealed at CONCACAF congress

PANAMA CITY, April 18 (Reuters) -

A detailed account of serious financial mismanagement within CONCACAF, the governing body for soccer in North and Central America and the Caribbean will be presented to the sport's leaders on Friday.

CONCACAF's congress will hear a breakdown of the 'forensic audit' that was ordered by president Jeffrey Webb, who succeeded long-time leader Jack Warner after he quit following a cash for votes scandal in 2011.

FIFA president Sepp Blatter will attend Friday's congress along with secretary general Jerome Valcke and delegates from 40 member nations.

CONCACAF's executive committee met on Thursday for five hours with members declining to talk afterwards about the contents of the audit.

However five separate congress delegates who claimed knowledge of the report's contents but who declined to speak on the record, all indicated to Reuters there were serious cases of financial malpractice detailed.

"It's bad, it's very bad," said one delegate who confirmed the report contained further details on the disputed ownership of the $22.5m Joao Havelange Centre of Excellence in Trinidad.

At last year's congress in Budapest, held in conjunction with world governing body FIFA's, delegates were told that CONCACAF did not legally own the centre, as all its members had thought, but that two companies owned by Warner had ownership.

Warner, a former FIFA vice-president and minister in the government of Trinidad and Tobago, stood down from all positions in the game thus avoiding a FIFA Ethics Commission inquiry relating to bribery allegations surrounding the FIFA presidential election.

Long term general secretary American Chuck Blazer, who turned against Warner and made public allegations of corruption against him and other Caribbean officials, also quit his position in December 2011 and is no longer employed by CONCACAF.

Since at least the summer of 2011, the FBI has been examining more than $500,000 in payments made by the Caribbean Football Union (CFU) over the past 20 years to an offshore company headed by Blazer during a time when Warner was also head of the CFU, a position he held from the early 1980s until 2011.
The precise reasons for many of those payments is unclear. In 2011, Blazer said the payments were meant to be repayments to him by Warner of "a significant amount of money" which Blazer said he loaned to Warner in 2004. Warner has told the media in Trinidad the payments were above board.

A law enforcement source told Reuters last month that Warner's son Daryan was a "cooperating witness" in the investigation.

The U.S.'s Internal Revenue Service has joined in the CONCACAF probe, which is looking into potential violations of U.S. tax and anti-fraud statutes, law enforcement sources told Reuters last month.
The allegations against Warner, who is Minister of National Security in Port of Spain, are creating political heat in Trinidad and Tobago.

The country's opposition leader Keith Rowley has filed a motion in the Parliament questioning the failure of prime minister Kamla Persad Bissessar to deal with the controversies.

"Those international stories on Mr. Warner are making us look like the most corrupted country on the face of the earth, are sullying our reputation and yet we have a prime minister who does nothing about Warner," Rowley, the leader of the People's National Movement told Reuters.

Local media investigations in Trinidad have also made allegations of internal financial wrongdoing by Warner while he was a 'special advisor' to the country's Football Association.
Warner has frequently denied any malpractice.

Friday's congress will also vote on a new member of FIFA's executive committee to replace Blazer with U.S. Soccer chief Sunil Gulati and Mexican Football Federation president Justino Compean competing for the spot.

Several delegates said the vote was likely to be extremely tight.

THE Government continues to support National Security Minister Jack Warner.

At yesterday’s post-Cabinet news conference at the Office of the Prime Minister, Communications Minister Jamal Mohammed reiterated: “the Minister of National Security, Mr Jack Warner, enjoys the full support of every single member of the Cabinet.”

“We stand firmly behind Minister Warner. He is one of the most hardworking ministers in our Cabinet and we wish more people had that work ethic like Mr Warner,” Mohammed declared. He said no matter involving Warner was discussed yesterday by Cabinet, but Warner discussed security issues in the wake of the Boston bombings.

On Tuesday, Opposition Leader Dr Keith Rowley said he filed a private motion in the House of Representatives which calls on Prime Minister Kamla Persad-Bissessar to take action to protect “the image and interest of the people of Trinidad and Tobago which are consistently being damaged by the actions and business of the Minister of National Security.” The motion will be debated in the House on April 26.

In his motion, Rowley said Warner and his business partners, “which include members of his family, have been linked to, or associated with a number of investigations into alleged misconduct and/or alleged criminal offences, both locally and internationally, which have attracted both locally and internationally.” He said Warner’s public utterances “have been the subject of widespread adverse commentary, censure and adverse inferences, both locally and internationally.”

Against this background, Rowley wants the House “to express its disapproval of the refusal of the Prime Minister to take appropriate action” regarding matters concerning Warner.

Persad-Bissessar, who is currently in Washington DC, instructed Attorney General Anand Ramlogan to write US Attorney General Eric Holder Jr to seek clarification on a Reuters story which claimed that Warner’s son Daryan is a cooperating witness in an FBI investigation into alleged corruption in international football. To date, Ramlogan has not received of any reply from Holder.

Jack Warner will rise again and the world will beg him him to return and he will say "NO".............
