British arbitrator Ian Mill, QC, ruled yesterday that 16 members of the Trinidad and Tobago World Cup squad are entitled to 50 per cent of the net profits Trinidad and Tobago Football Federation (TTFF) derived from the Road to Germany 2006 campaign.

The question for determination now is how much is 50 per cent of the net profits?

In a 30-page judgment delivered yesterday, Mill detailed the dispute between the players and the TTFF, which had its genesis in 2004, when T&T began the World Cup journey to Germany.

The players had originally agreed to 30 per cent of the net profits, but that was changed to 50 per cent after meetings with the TTFF and its special adviser, Jack Warner.

According to Mill, the 50 per cent was finally agreed upon on June 12, 2006. Mill stated:

“It seems to me that the applicants (players) have done enough to raise a case for the TTFF to answer in this respect. I therefore find, not without some hesitation, that Mr Warner did promise on June 12, 2006, to increase the players’ share under the commercial revenues sharing agreement from 30 per cent to 50 per cent, in order to obtain ‘practical benefits’ for the TTFF, and that therefore, that promise was, and is, legally binding on the TTFF.”

The arbitration hearing was held between April 28 and 30 in the London Headquarters of the Sports Dispute Resolution Panel.

Now that the arbitrator has determined that the players are entitled to 50 per cent of the net profits, the next step for the arbitrator is to determine what figure should be paid out.

A case management hearing will take place in London in June, when dates will be set for the trial some time later this year.

Both parties agreed that the arbitration hearings will be in private, and no one is allowed to disclose the contents of the proceedings and/or the judgment.

In his judgment, Mill said he was disappointed that neither Warner nor the TTFF secretary Richard Groden appeared during the hearing in April.

The arbitrator indicated in his judgment that he hoped the TTFF would provide a proper account of the monies received to the players.

“Obviously, I hope that the effect of this decision will be that a proper account will expeditiously be rendered, together with the payments shown as due by that account and sufficient inspection of the TTFF’s records to enable the applicants reasonably to be satisfied that they have received that to which they are entitled.

“In that context, I should observe that any agreement entered into prior to qualification for the World Cup Finals, but which resulted in revenues accruing to the TTFF in consequence of qualifying, should be disclosed by the TTFF to the applicants.”

The players argued that the T&T Government published a figure of $173 million which the TTFF supposedly received during the campaign, but the TTFF disputed this, saying the figure was much less.

During the hearings in London, four players gave oral evidence before the arbitrator: goalkeepers Shaka Hislop and Kelvin Jack, defender Brent Sancho, and striker Stern John.

The 16 players who took the TTFF to arbitration were: Marvin Andrews, Christopher Birchall, Atiba Charles, Cyd Gray, Ian Cox, Cornell Glen, Shaka Hislop, Avery John, Stern John, Kenwyne Jones, Kelvin Jack, Collin Samuel, Brent Sancho, Aurtis Whitley, Evans Wise and Anthony Wolfe.

Representing the players were British attorneys Rupert Butler and Mike Townley, while Englishman William Mc-Commick, assisted by Trinidad lawyers Om Lalla and Kelvin Ramkissoon, appeared for the TTFF.

The impasse started in the Port-of-Spain High Court last year, but the TTFF took the preliminary point that this matter was not suitable for litigation.

The Federation asked for the matter to be stayed and resolved by an arbitrator. The arbitration proceedings were then filed in London on October 4.

The players contended that after TT defeated Bahrain 2-1 on aggregate to qualify for the World Cup Finals, the TTFF received US$5.6 million from FIFA.

As a result, the players argued that there was an inevitable commercial spin, in that sponsors paid large sums of money to be associated with any of the teams reaching the finals.

i need a memory refresher..

wasn't what jack gave the players 50% of the "net" in the first place.

"Net" = (TTFF Falsely stated revenues) - (All possible deductible expenses from airfare to shoelaces)

So the real bone of contention is what is the actual revenue that the TTFF got and grossly misrepresented not so??

This one line in the whole ruling has me worried the most:

What he mean by he hope TTFF give a proper account ???  Sound kinda toothless to me...

Nothing being mandated here and as such nothing landmarkish as yet imo.

Just another step in the right direction.

Most likely they'll go before the CAS panel now...arbitration is what the TTFF called for.

More media spotlight is meaningless really...Jack and the TTFF will just continue to imperiously disregard them.  Now that the arbitrator has ruled that there is a duty owed to the players (by way of 50% rights), the next step is to determine 50% of what?  In all likeliness an independent review will be ordered by the next panel (likely at the expense of both parties). 

With so much publicity accompanying many of the sponsorship deals and other revenue streams which the TTFF enjoyed in the run-up to and post-Germany, not even the most 'creative' of accounting will save the TTFF from forking over a sizeable check to the players.

I know its still early in T&T, but I'm surprised there haven't been more comments on this story so far.

After all, this is the day that many said would never come. TTFF/Warner have lost their case. Ok, its arbitration, not court, but the implications aren't a lot different. It has been proved that TTFF went back on their agreement. All of the namecalling and blacklisting by TTFF was completely uncalled for. The players were right and its taken them nearly two years to prove they were right.

So what happens now? Does the arbitrator order TTFF accounts to be audited. If so, is this the beginning of the end for TTFF?

Wait nah...Scotty not in the 16 who take the TTFF to court?

Hmm, Berris boy...I feel Stern days numbered now if is a straight tussle between him and Scotty for one spot.

But honestly, I think this was the easy part because it was clear that a deal was made. The issue now is how long the TTFF can drag this on for before we see the actual figures.

Bear in mind that we are in court now...this is not FIFA. Once the books and figures come to light, all Jack bobol WILL land him in jail so Jack cannot just hand it over. He fighting for his life, not just his 'good name' and career.. Especially because I don't think this is now a Trinidad legal matter, so it have no buying over of witnesses and police messing up the evidence etc. U can do creative accounting but the boldfaceness with which Jack is operate, it will be hard at this point.

Finally a measure of vindication with some legal weight behind it. Hopefully this is the beginning of the cementing of transparency and effort on the part of the TTFF.

We know is accounting 101 but right here on dis site we show dat dem books did not include all d money including for eg d withholding tax that say dat d German gov't take but was not take. At d end dey go get more than d 5000TT.

Sixteen members of Trinidad and Tobago's 2006 World Cup squad are in line for six-figure pay-outs after winning a dispute over cash owed from the tournament.

The players, who include Sunderland striker Kenwyne Jones, Southampton forward Stern John and former West Ham and Newcastle keeper Shaka Hislop, had taken their case against the Trinidad and Tobago Football Federation (TTFF) to an arbitration hearing in London last month.

Now the arbitrator Ian Mill QC has ruled that the players are entitled to 50% of the cash the TTFF earned from sponsorship revenues and half the profits from six pre-World Cup friendlies.

The exact figure each player should receive has yet to be decided upon by Mill but they should be in line to pocket around £125,000 each.

FIFA vice-president Jack Warner, the TTFF's special adviser, who made the initial agreements with the players, had originally offered them around £500 per player.

The 16 refused and began legal action believing they were entitled to much more.

The Sports Dispute Resolution Panel in London were told last month that the TTFF had signed a £5.5million ($11.5million) sponsorship deal with adidas before the World Cup and that the players were entitled to half that sum plus 50% of FIFA's participation money and profits from pre-tournament friendlies.

Neither the TTFF nor the players are permitted to comment as the arbitration ruling contains a confidentiality clause.

But a leaked copy of Mill's ruling states: "It seems to me that the applicants (players) have done enough to raise a case for the TTFF to answer in this respect.

Nice initial decision but it simply confirms what we already knew and continues to request transparency from the TTFF.  Left to be seen how the players get to the next step.
