Ontario judge overturns Canada anti-prostitution laws
The judge found the laws force sex workers to choose between safety and liberty A judge in Ontario has overturned key Canadian anti-prostitution laws, finding they force sex workers into the streets at risk to their safety.

She ruled with three prostitutes who had challenged bans on brothels, pimps and solicitation.

The ruling applies to Ontario province but could, if upheld on appeal, allow the rest of Canada to follow suit.

One sex worker said she no longer had to fear rape, robbery and murder. The government is weighing an appeal.

'Emancipation day'
 
Finding the laws unconstitutional, Justice Susan Himel called on the Canadian parliament to regulate the sex trade.

"These laws... force prostitutes to choose between their liberty, interest and their right to security of the person," she wrote in a 131-page ruling in the Ontario Superior Court of Justice.

Plaintiff Terri Bedford, described in court documents as a prostitute who had been beaten and raped while working in the streets of Windsor, Calgary and Vancouver, said: "It's like emancipation day for sex trade workers."

Ms Bedford said she hoped to work as a dominatrix.

"The federal government must now take a stand and clarify what is legal and not legal between consenting adults in private," she said.

Justice Himel found national laws banning brothels, forbidding solicitation of clients, and banning Canadians from managing sex workers as pimps or madams violated a provision of the Canadian Charter of Rights and Freedoms guaranteeing "the right to life, liberty and security".

Supporters of the overturned laws fear the ruling will make Canada a haven for human traffickers.

The ruling will not go into effect for 30 days, giving the government time to appeal if it chooses.

Street prostitution in Canada has been under increased scrutiny in recent years following the trial of Robert Pickton, a Vancouver pig farmer convicted in 2007 in the killings of six sex workers.

Pickton is suspected in dozens more killings. A Canadian court this summer denied him a new trial.

The Ontario Superior Court struck a blow for sane legislation yesterday when it struck down laws against communicating for the purposes of prostitution, living off its avails and running a “common bawdy house” — i.e., a brothel. Like it or not, the exchange of money for sexual services between consenting adults is legal in Canada. And as a general rule, if we lack the constitutional power or the intestinal fortitude to outlaw something, we should resolve to live with the consequences and not resort to erecting artificial, counterintuitive laws designed to prevent legal behaviour.

Prostitution is not a trade any parents would choose for their children. No matter where or how it’s carried out, it’s unlikely to be particularly safe or salubrious. “Any time you are alone with a john, it is dangerous,” the Crown argued in the case decided yesterday. “There is no safe haven when you are involved in prostitution. There is overwhelming evidence that johns can become violent at any moment.” That sounds alarmist, but even if it’s true, the laws struck down made the problem worse, not better. The communication law is designed to deal with street prostitution, which is widely and correctly seen as an urban menace. But it’s at cross purposes with the living off the avails and bawdy house laws, which criminalize behind-closed-doors prostitution and incentivize street prostitution.

Prostitution is not called the oldest profession for nothing; it’s not going away. Given that reality, it’s vastly preferable that prostitution be conducted in safe, controlled, monitored and legal surroundings (e.g., legalized or decriminalized brothels), potentially with paid security guards and a database of customers good and bad, rather than on sketchy street corners where prostitutes must judge their clients quickly, blindly and too often — as the Robert Pickton murders demonstrate — wrongly. “By increasing the risk of harm to street prostitutes, the communicating law is simply too high a price to pay for the alleviation of social nuisance,” Judge Susan Himel wrote in her 131-page ruling. We agree. The case seems destined to wind up in the Supreme Court. But in the meantime, the federal government must use this as an opportunity to reassess its stance on prostitution. As part of its move to crack down on so called “serious crimes,” it actually proposes to increase penalties for operating a common bawdy house. This is misguided in the extreme.

It’s time for Canada’s prostitution laws to enter the world of common sense.

What you call a quick defense is really an attempt to educate you of YOUR pre-existing condition.  Please don't let it become ego-dystonic. embrace yuhself, hug yuh inner man chile like you alone can do it...free yuhself.

I actually Never spent time on crowded ships full ah "sea menz" as you put it.  I see that you are also wel versed and can recall with clarity and haste the names of your American heroes....  how is your stance?

A Alan Young, the Toronto law professor who led the court challenge, said he does not expect any dramatic changes in the short term. “It would not be a wise investment,” to open a brothel immediately, Mr. Young said. “The law is still fluid,” he stressed, since the case is likely to end up at the Supreme Court of Canada. The judge’s ruling is binding on provincial court judges in the province, where nearly all of the charges laid under these sections are heard. The decision this week may lead to a temporary legal limbo in Ontario, similar to what happened in 2003 when there was no law against simple possession of marijuana because of flaws in the rules regarding medical use, until the issue was heard by the provincial Court of Appeal.
