TTFF, Soca Warriors get new court date.

The Appeal Court is set to begin hearing arguments between the Trinidad and Tobago Football Federation (TTFF) and 16 members of the 2006 Soca Warriors team, regarding the payments of monies owed to the players stemming from their World Cup qualification.

The matter came up for hearing yesterday before Justice Rajendra Narine and has been adjourned to November 8, when a panel will adjudicate over the proceedings.

Attorney Kelvin Ramkissoon appeared on behalf of the TTFF, while attorney Dave DePeiza is seeking the interests of the footballers.

The appeal comes on the heels of Rampersad's July 29, ruling, in which the TTFF were ordered to honour their bonus agreement with the players. The judge also ordered the TTFF to absorb the legal costs on behalf of the players.

Local court proceedings were initially filed in November 2008, at the Port of Spain High Court, where the 16 players demanded the High Court enforce the judgement of the London-based Sport Dispute Resolution Panel (SDRP).

The SDRP had ruled in May 2008, that under the terms of a contract agreed by FIFA executive committee member and the TTFF special adviser Jack Warner, the Soca Warriors were owed 50 per cent of all 2006 World Cup commercial revenue.

The footballers in their lawsuit had requested an interim payment of roughly $1.8 million each and their share of the $88 million which the TTFF claimed to have received as World Cup commercial revenue.

However, the TTFF claimed that a breach of confidentiality by the players meant they were (TTFF) were no longer obligated by the agreement.

Following weeks of arguments, Rampersad ruled in favour of the players.

Within hours of receiving Rampersad's ruling, the TTFF and by extension president Oliver Camps appealed Rampersad's decision seeking to have it nullified.

The players who filed the lawsuit are Marvin Andrews, Shaka Hislop, Kelvin Jack, Atiba Charles, Cyd Gray, Ian Cox, Avery John, Brent Sancho, Chris Birchall, Aurtis Whitley, Collin Samuel, Evans Wise, Anthony Wolfe, Cornell Glen, Kenwyne Jones and Stern John.

This case get relegated to Kelvin Ramkissoon instead of Om Lalla. I feel the players goign to win soon cause Om busy preparing defences for his number one client against the potential more difficult government scandals that will come inevitably.

Just as important...the fact that there was no previous reference to him in the story at all...

This was more the reference I was making... out ah de blue they start dropping "Rampersad" references like the reader intuitively would know who they talking about.  Ah mean, we who following the saga know, but the average man on the street was probably scratching he head in confusion.

Basically, TTFF are still arguing that the breach of confidentiality has made the arbitration ruling null and void. The judge hearing the appeal is trying to understand why TTFF have only recently appealed, rather than appeal immediately after the arbitration, as the prescribed in the legal process. There is no new evidence and TTFF have never appealed that the ruling was unjust or unsound. TTFF even had their British lawyer, McKenzie in court.

Seems that the judge is struggling to find any reason to uphold the appeal, particularly as there is still no evidence of who made the leak.

My guess is that no matter how much legal gamesmanship takes place from TTFF, T&T judges won't be mammaguyed into supporting them unless there are strong valid legal reasons. It seems that the tide may have changed and suddenly, the name Jack Warner, bears no weight in the courtroom.

If the judge rules against TTFF on 15th, it will be interesting to see how they will deal with Mr Rampersad on 26th. After all, instead of complying with his orders to provide information for 26th, TTFF have instead entered into yet another frivolous time wasting excercise.

I still don't understand how they are allowee to run up huge legal costs when part of the money being spent is from the taxpayers. I know the government aren't supposed to intervene due to FIFA rules, but isn't that what Anil did on saturday when he critiscised the players?

I understand that today, Appeal Court Judge Rajendra Narine decided to lift the stay preventing 16 members of the 2006 Soca Warriors World Cup team from receiving money owed to them by the Trinidad and Tobago Football Federation (TTFF). 

I also understand that TTFF will now request more time to provide the accounts and documents requested by Judge Ramersad on 29th July to assist his ruling on 26th November.

I also understand that the players have no problem with allowing TTFF more time providing TTFF make the interim payment of TT$44 million (50% of uncontested figures of TT$88 million) plus legal costs.

If the requested documents are not produced it will be interesting to see which punative route Judge Rampersad will take, remembering that Richard Groden stated in the press two years ago that KPMG have a complete set of accounts, TTFF have never contested the figure of TT$180 million, and, of course, every public company (particularly those that receive funding from government) have to file audited accounts every tax year.

It is also interesting that TTFF are paying huge salaries to its employees such as Russel Latapy, so TTFF cannot proclaim bankruptcy.
